High Court Rules President Ruto’s Health Taskforce Unconstitutional

The High Court has declared the health taskforce appointed by President William Ruto unconstitutional.

Justice Bahati Mwamuye on February 6th, 2025, declared the Presidential taskforce unconstitutional directing the Ministry of health to fully implement the Kenya Health Human Resource Advisory Council within 30 days.

However, the Attorney General asked the court to suspend the decision for 30 days as the tenure was near its end by justice Mwamuye declined the application.

The 20-member Taskforce on Human Resources for Health was established in July 2024.

The task force was to serve a 6-month term.

Yet, President Ruto on December 13th announced an extension effective January 5th 2025.

The taskforce is chaired by Khama Rogo with Judith Guserwa acting as the vice chairperson and Edna Tallam and Morris Kaburu as joint secretaries.

The main aim of forming the Taskforce was to address critical challenges in Kenya’s healthcare sector.

This was however declined by the Law Society of Kenya (LSK) and other civil groups who arguing that the taskforce’s formation was unconstitutional.

They claimed that it duplicated and usurped the mandate of the Kenya Health Human Resource Advisory Council which is a statutory body established under the Health Act of 2017.
