Rigathi Gachagua’s Impeachment Court Case To Be Heard in 2025

High court has pushed the petition challenging impeachment process of Rigathi Gachagua to be mentioned January next year.

The petitioners had asked the court to wait for the decision of the Court of Appeal in the case in which Gachagua challenged the decision that ruled that Deputy Chief Justice Philomena Mwilu did not violate constitution when she appointed the three-judge bench.

The court had heard three petitions.

On of the petitions was withdrawn in the ruling as the court allowed the amendment of the petition within thirty days.

The petition was fixed to January 23rd, 2025.

The petition included petition challenging the impeachment of the former president.

The ruling came after Gachagua appealed a case against the formation of the three-judge bench by Justice Mwilu was set to be heard in December 2023.

On 6th Wednesday, Gachagua had wanted his matter to be prioritized on the basis owing to its public interest nature.

Gachagua argued that the ruling made by the three-judge bench for the deputy president Kithure Kindiki to be sworn in was unconstitutional and illegal as according to him, the matter of his replacement should have been constituted by Chief justice Martha Koome.

Gachagua withdrew some parts of his appeal as he said they were overtaken when Kithure was sworn in as the Deputy President of Kenya who was sworn in on 1st November 2024.
