OCS Talam Seeks to Halt Prosecution in Blogger Ojwang’s Death

OCS Samson Taalam along with police constable James Mukhwana, have moved to court to stop his prosecution for the death of blogger Albert Ojwang while in police custody.

According to the two, the Independent Policing Oversight Authority (IPOA) initiated criminal proceedings against them prematurely without following the legal procedure for deaths in police custody.

The two argued that bypassing the requirement violated due process and denied them the right to a fair investigation.

Talaam also claimed that he was not on duty at the time of Ojwang’s detention, having passed responsibility to his deputy.

Regarding the matter, the court directed the OCS on Tuesday to serve the respondent with the Notice of Motion, dated June 15, 2025, within three days.

He is also required to file an affidavit of service confirming compliance.

The matter has been scheduled for further directions on June 30, 2025.

IPOA on the other hand, has applied to detain him for 21 days in order to complete the ongoing investigations over concerns that his release would interfere with the investigations.
