Nairobi Lawyer Charged Following Alleged KSh49.4 Million Misappropriation

The Directorate of Criminal Investigations (DCI) has apprehended a Nairobi-based advocate over allegations that he misappropriated Ksh49.4 million entrusted to him to facilitate the purchase of a parcel of land.

According to statement by the DCI, the suspect was arrested by detectives from the DCI Nairobi Regional Office and is expected to face charges of stealing by an agent as investigations into the matter continue.

The complainant reportedly transferred a total of Ksh49,400,500 to the advocate in several instalments between November 16, 2023, and January 3, 2024, for the purpose of completing the land transaction.

The complainant had entrusted the funds to the advocate handling the transaction, with the payments made on different dates between November 2023 and January 2024.

“Investigations established that the complainant entrusted the suspect with Sh49,400,500 on diverse dates between 16th November 2023 and 3rd January 2024 to facilitate the purchase of the land,โ€ DCI stated.

The matter came under the attention of the DCI Nairobi Regional Office as detectives began reviewing the circumstances surrounding the handling of the funds and transaction.

The authority found out that the money was diverted from the intended land purchase and used for personal purposes, leading to the ongoing criminal inquiry.

The allegations have resulted in action against the legal practitioner after detectives established grounds to pursue a case of stealing by an agent under the law, cited under Section 283(b) of the Penal Code, which forms the basis of the charges being investigated by authorities in the matter.

The DCI later arrested the advocate in Kilimani Sub-County, Nairobi, over the alleged theft and placed him in custody pending further processing.
