Kindiki Urges Judiciary to Lift Ban on NTSA Instant Fines

Deputy President Kithure Kindiki has urged the judiciary to reconsider its decision to halt the implementation of the National Transport and Safety Authority (NTSA) instant fines system.

In a statement on Tuesday, April 7, Kindiki said the government introduced the new traffic enforcement measures in response to rising road fatalities across the country.

He explained that the measures are aimed at improving road safety through the use of technology and stricter penalties to deter reckless driving.

These include the installation of speed-monitoring cameras, instant fines for traffic offenders, and tougher demerit penalties for drivers and vehicle owners responsible for accidents causing injury or death.

Kindiki expressed concern that the court’s intervention has delayed the rollout of the measures at a critical time when the government is working to curb road accidents. 

He noted that the injunction issued a few weeks ago has temporarily halted the implementation of the new traffic enforcement system.

Kindiki has called for a balance between legal processes and public safety, urging the judiciary to allow the implementation of the measures to proceed as the case continues in court.

The High Court had earlier issued conservatory orders temporarily blocking NTSA from enforcing the instant fines traffic management system. 

The orders were issued by Justice Bahati Mwamuye following a petition filed by lawyer Shadrack Wambui.

The court directed NTSA and other relevant parties to suspend the rollout and enforcement of the system pending the hearing and determination of the case. 

It also barred the use of automated systems to issue or enforce instant traffic penalties.

Additionally, the petitioner was instructed to serve all parties with the necessary documents and file proof of service. 

The case is scheduled for mention on April 9, 2026, to confirm compliance.
