Fair Hearing Breach: Tribunal Rules Against ODM in Sifuna Case

The Political Parties Disputes Tribunal (PPDT) has ruled in favour of Nairobi Senator and Orange Democratic Movement (ODM) Secretary General Edwin Sifuna, finding that the party violated his right to a fair hearing before initiating disciplinary.

In a ruling on June 18, 2026, the Tribunal held that ODM failed to adhere to the principles of procedural fairness and due process in its handling of the matter.

It also found out that the party’s actions contravened legal requirements governing disciplinary proceedings.

Therefore, rendering the steps taken against Sifuna procedurally unfair and invalid.

The tribunal ruled that the disciplinary process was unlawful from the outset.

However, the Tribunal clarified that its ruling does not prevent ODM from taking disciplinary action against Sifuna in future, provided any fresh proceedings are conducted in accordance with the law, the party constitution and its internal rules.

“The Tribunal directed the Party to proceed and conclude any disciplinary proceedings lawfully initiated against the Senator,” ODM said in a statement.

According to reports, the dispute stems from growing political divisions within ODM, particularly over the party’s relationship with President William Ruto’s Kenya Kwanza administration and the cooperation agreement signed between ODM and the government in March 2025.
