The three-judge bench of the High Court has declared Kenya Kwanza not the Majority party in the National Assembly.
This meant that Speaker Moses Wetangula’s decision that determined Kenya Kwanza as the Majority in parliament null and void.
On 6th September 2022, Speaker Moses Wetangula made the decision when 14 members from various parties were reassigned to Kenya Kwanza favoring the coalition and enabling it to claim majority status.
According to him, Kenya Kwanza had 179 members in parliament while Azimio la Umoja One Kenya Coalition party had 157.

However, the official documents from the Registrar of Political Parties indicated that as of April 21, 2022, Azimio compromised 26 political parties whereas Kenya Kwanza had only 15.
“The speaker cannot fault the Registrar of Political Parties. She could not provide what she did not have. The speaker ought to have presented the agreements that were allegedly submitted during the debate. Without the post-election coalition agreements, he had no basis for his decision” the three-judge bench ruled.
“By assigning Kenya Kwanza he 14 members from other parties without justification and declaring if the majority party, the Speaker violated the Constitution” court ruled.
The court also found Wetangula’s dual role as speaker and leader of Ford Kenya was unconstitutional.
The public is yet to know if the decision will lead to the realignment of Parliament.
