A senior official at the National Government Constituencies Development Fund (NG-CDF) has been convicted over procurement irregularities for a Ksh19 million public project in Malindi.
According to a statement by the Director of Public Prosecutions (DPP) the official served as a constituency fund account manager and was convicted alongside the director of a private contracting firm involved in the project.
“The DPP has secured the conviction of a senior National Government Constituency Development Fund (NG-CDF) official and a private contractor in a corruption case involving the irregular award of a Ksh19 million public project in Malindi,” the statement read.
The court found the two guilty after determining that the prosecution had proved its case beyond a reasonable doubt.
It dismissed the defence arguments, finding the prosecution’s evidence from more than 10 witnesses credible.
The NG-CDF account manager was convicted for failing to comply with procurement laws during the award of a tender for a public education office block.
The court also found out that the official approved the award of the contract for the construction without obtaining the mandatory professional opinion required under procurement regulations.
According to the statement, the official has been fined Ksh400,000 or will serve six years in prison if the fine is not paid.
The private contractor, who was involved in the tender application process, was convicted on three counts of forgery and one count of presenting a false document.
The court further found that the contractor submitted forged documents, including professional credentials and financial records, to support the bid for the public project.
The contractor was fined Ksh200,000 on each of the four counts or will serve two years in prison on each count, with the sentences running concurrently.
