Constable Recruitment to National Police Service Suspended by Court

The High Court has temporarily suspended the ongoing recruitment of constables to the National Police Service (NPS).

Justice Bahati Mwamuye issued the conservatory order on Monday, November 10, after a petition was filed by Eliud Matindi challenging the legality of the recruitment exercise.

Justice Bahati Mwamuye directed the petitioner to promptly serve the respondents and interested parties with the application, petition, and court order, and to file an affidavit by the close of business on Wednesday, November 12, 2025.

The judge further instructed the respondents and interested parties to enter appearance and submit their respective responses by Tuesday, November 11, 2025.

The case is scheduled for mention on January 22, 2026, to confirm compliance with the court’s directives and to provide directions for an expedited hearing and determination.

Earlier, on Tuesday, November 4, the National Police Service (NPS) had announced that the recruitment of police constables would take place on Monday, November 17, 2025, at designated centers across the country starting at 8:00 a.m.

This marks the second time the High Court has suspended the recruitment of police constables.

On October 2, the Employment and Labour Relations Court halted a similar nationwide exercise after former MP Harun Mwau filed a petition challenging its legality.

Justice Hellen Wasilwa later declared the recruitment unconstitutional, ruling that the National Police Service Commission (NPSC) lacks the authority to recruit or manage officers, powers that rest solely with the Inspector General of Police.
