National Assembly Speaker Moses Wetangula has declined the ruling by the High Court that his dual role as the Speaker of Parliament and Ford Kenya party leader is unconstitutional.
The ruling was delivered by the three-judge bench found Wetangula’s role as speaker and leader of Ford Kenya unconstitutional.
“The dual role is unlawful and unconstitutional. Once he became the Speaker of the National Assembly, he ceased to be the leader of Ford Kenya” the court ruled.
This left Wetangula in a dilemma as he had to resign from one of the roles.

The National assembly Speaker on the other hand halted to resign from any of the roles and clarified that he holds both roles despite the ruling.
Through his legal advisor Benson Milimo, the Ford Kenya party leader made it clear that he will not quit from any of the roles.
“There is absolutely no change of status. Dr. Moses Masika Wetangula remains the party leader of Ford Kenya as well as the Speaker of the National Assembly” Milimo said.
“I want to assure the nation and the Ford Kenya fraternity that there is no cause for alarm. What the court did was to make comments, which ordinarily is called per incuriam in law. Comments that have no binding and have no consequential effect” he added.
Milimo further said that the court did not rule that Wetangula should cease holding office of the speaker or the title of Ford Kenya party leader.
