The former Law Society of Kenya (LSK) Nelson Havi has been found guilty of professional misconduct by the Advocates Disciplinary Tribunal.
According to the tribunal, the former LSK president had alleged that Gichuhi, a former LSK President and his predecessor, was involved in theft and funds.
The statements were said on his X account and during an interview on a local TV station on July 12 and 13, 2021.
The case was filed by Gichuhi who argued that the posts shared on X caused him mental anguish.
The tribunal described Havi’s posts as abusive and demeaning of standards expected of a senior advocate.
“The legal profession is known for its decorum, dignity and culture. Young advocates are entitled to see the right examples and role models in the profession,” the tribunal added.
They further cautioned that the trend of public mudslinging among legal professionals could erode public trust in the legal system.
Havi, on the other hand, dismissed the tribunal’s conclusion as ‘unlawful and unconstitutional’.
