The High Court has awarded tech entrepreneur Ndiang’ui Kinyagia Ksh5 million in damages after finding that his constitutional rights were violated during a Directorate of Criminal Investigations (DCI) raid at his home in June 2025.
Justice Patricia Nyaundi found that DCI officers unlawfully entered and searched Kinyagia’s home and seized his property during the height of the June 2025 protests.
The court determined that the raid violated his rights to privacy, property, dignity, security of the person and freedom of movement.

Justice Nyaundi also found that a medical assessment conducted after the incident established that Kinyagia experienced psychological distress following the raid, which forced him into hiding.
The judge further barred the National Police Service (NPS) and the Director of Public Prosecutions (DPP) from prosecuting Kinyagia using evidence obtained during the unlawful search and seizure.
The court found that law enforcement officers had conducted the search and seized property before obtaining lawful authority, and only sought to justify their actions afterwards.
Justice Nyaundi directed the DCI and Inspector General of Police Douglas Kanja to jointly pay Kinyagia the Ksh5 million compensation, together with interest from the date of judgment and the costs of the case.
Kinyagia went missing after the DCI raided his home in June 2025, following claims linking him to a social media account associated with a viral post calling on Kenyans to march to State House.
At the time, then-DCI Director Amin Mohamed confirmed that Kinyagia was a person of interest but denied that he was in police custody.
Kinyagia later appeared in court days after a petition was filed seeking orders requiring law enforcement agencies to produce him before the court.
He appeared visibly shaken during the court proceedings, while his lawyers requested privacy as he was reunited with his family.
