High Court Allows LSK to Proceed With Police Misconduct Case

The High Court has rejected an attempt to dismiss the case filed by the Law Society of Kenya (LSK) against police misconduct during the 2024 demonstrations.

The court instead upheld its jurisdiction to hear and decide the case while dismissing the police objection.

The police, on the other hand, claimed that LSK failed to exhaust all internal disputed resolution options before seeking court intervention.

However, Justice Lawrence Mugambi ruled that the police Act does not provide specific reliefs for complainants other than disciplinary action against officers.

He added that the existing internal mechanisms are insufficient to address violations of fundamental rights and freedoms.

In June last year, Kenyan youths decided to protest against the Anti-Finance Bill 2024, which left others deceased while others were injured.

Among the people confirmed dead was Rex Maasai, which forced LSK to file a lawsuit to hold the officers responsible for his death accountable.

Following Justice Mugambi’s ruling, the case will be expected to proceed to a full hearing.
