Court Orders Police Chiefs to Produce Missing Businessman Ibrahim Mohamed

The High Court has issued a habeas corpus order directing Inspector General of Police Douglas Kanja and DCI Director Mohamed Amin to present the missing businessman, Ibrahim Mohamed, before the court, whether alive or dead.

Justice William Musyoka gave the directive on Thursday, February 5, after Busia Senator Okiya Omtatah filed a petition seeking answers over Mohamed’s disappearance.

The judge further ordered that if the two officials fail to produce him, they must submit sworn affidavits within 24 hours explaining in detail the circumstances surrounding his arrest, detention, or continued confinement.

Mohamed disappeared two weeks ago after he was reportedly taken off a Nairobi-bound bus at a roadblock. 

The Busia-based businessman was said to be carrying Ksh17 million in cash at the time.

His disappearance on Wednesday, February 4, triggered protests in Busia town, as residents and family members demanded to know his whereabouts. 

Police later dispersed the demonstrators using tear gas, and several people were arrested and taken into custody.

Senator Okiya Omtatah has since urged Inspector General Douglas Kanja and DCI Director Mohamed Amin to comply with the court’s directive and present Mohamed without delay. 

He stressed that obeying the order is a constitutional duty and called on the public and civil society to remain vigilant in seeking accountability.
