High Court Rejects Bail Request for Former Governor Waititu

The High Court has rejected a request to grant ex-Kiambu governor Ferdinand Waititu bail amid his appeal.

According to the court, the former governor had failed to present sufficient grounds to warrant his release.

Waititu had argued that one of the reasons for him seeking bail was health concerns, citing that his medical condition required urgent and constant attention.

However, on a court ruling delivered on Monday, 3, 2025, the court stated that the prison facilities are well equipped with medical services, and in case of serious health issues, convicts are referred to a referral hospital.

“It is in my finding that the applicants have not met the conditions for bail. The applications are hereby dismissed,” Justice Lucy Njuguna ruled.

She also noted that the right to bail is not automatic and that an applicant must demonstrate to the court that the appeal is arguable and has a chance to succeed.

The court also dismissed his argument that the appeal would take long in court, saying that the court diary will ensure that the appeal is heard and determined within two months since the main appeal has already been fined.

The former governor had filed for an appeal challenging a ruling which sentenced him to 12 years in prison or to pay 52.5M over Ksh.588M graft case involving a road tender in Kiambu County.
