Former Kiambu Governor Ferdinand Waititu could soon secure his release after agreeing to the court’s ruling on his bond conditions.
During a court session on Tuesday, Principal Magistrate Rose Ndombi reaffirmed the bond terms in the offensive conduct case but noted that the High Court’s requirement of a Ksh53 million bank guarantee must be fulfilled before Waititu can be freed.
The former governor is therefore expected to ensure the deposit of the Ksh53 million guarantee, while his bond conditions in the ongoing hate speech case will remain in effect.

Waititu told the court that arrangements have already been made for someone to deposit the guarantee on his behalf.
Once the Ksh53 million bank guarantee is deposited, Waititu will remain free, while his existing bond conditions in the hate speech case continue to apply.
The next hearing in the case is set for January 15, 2026.
The decision follows the High Court’s rejection of Waititu’s third bond review application just over a month ago, in which he sought to replace the Ksh53 million bank guarantee with cash deposits.
Justice Lucy Njuguna dismissed the request, noting that allowing the change would delay the progress of the case.
Waititu was convicted in February for mismanaging public funds after allegedly receiving Ksh25 million from a company through an irregular tender process.
He was sentenced to either pay a fine of Ksh53.5 million or serve 12 years in prison. He has been serving the sentence while seeking a review of his bond conditions on appeal.
