The High Court has declined to issue an order blocking Deputy Inspector General of Police, DIG Eliud Lagat, from returning to office.
According to a ruling by Justice Chacha Mwita, Lagat should be given a fair hearing before any interim orders can be issued.
The court has now directed the DIG to respond to the case filed by activist Eliud Matindi by July 23, 2025.
Lagat stepped down from his offices amid public pressure during the investigation into the murder of blogger Albert Ojwang who dies while in police custody at Central Police Station in Nairobi.

The DIG was the complainant in the case that saw Onjwang in jail, where he faced his untimely death.
The blogger was arrested for allegedly posting defamatory content about DIG Lagat on social media.
London-based activist sued the National Police Service and the Attorney General over the handling of leadership within the police service.
Matindi wanted an order prohibiting Lagat from carrying out any functions of a DIG.
