Former CJ Maraga: Presidents Can Be Prosecuted After Leaving Office

Former Chief Justice David Maraga has stated that under Kenyan law, a president can face prosecution after leaving office.

This comes amidst police brutality, extrajudicial killings, among others that are happening in the country under President William Ruto’s Regime.

“You can’t take a sitting President to court. But if he disobeys the law, flouts anybody’s rights, as soon as he leaves office, he can be taken to court”, CJ Marag said in an interview with Spice FM.

The former CJ’s remarks come after growing criticism of Kenya Kwanza administration over alleged abuse of human rights, police brutality and defiance of court orders.

Apart from that, several opposition leaders such as Martha Karua, Kalonzo Musyoka, Eugene Wamalwa and Mukhia Kituyi are in the process of compiling evidence to present to the ICC over alleged crimes against humanity, and the government’s crackdown on peaceful protests.
